When negotiating Due Diligence items it’s recommended to utilize the UAR form “Resolution of Due Diligence Addendum” (See link below). This form includes pertinent terms such as potential remedy for unfinished repairs, options to increase closing costs paid by seller or a price reduction. If a Resolution of Due Diligence addendum is countered, the countering party should also use the Resolution of Due Diligence Addendum. If the responding party does not agree or accept any terms of the Resolution, they can reject it. As with all other addenda the verbiage at the bottom applies: ALL OTHER TERMS of the REPC, including all prior addenda and counteroffers, not modified by this ADDENDUM shall remain the same.
